Description

QUALIFIED PROTECTIVE ORDER (Jeannice W. Appenteng, United States Magistrate Judge). This is a Northern District of Illinois order permitting the controlled use and disclosure of a plaintiff’s protected health information (PHI) during federal litigation. Issued under Rule 26(c) and 45 C.F.R. §164.512(e)(1), the order authorizes parties and their attorneys to obtain, subpoena, and exchange PHI solely for purposes of prosecuting or defending the case, including any appeals. Covered entities may disclose PHI to counsel, and all recipients—such as experts, consultants, court staff, and litigation support personnel—must be notified that the information may not be used outside the litigation. PHI must be returned or destroyed within 45 days after the case concludes, with an exception for filings made with the court.
