Description

RW1112 - PETITION FOR ADMINISTRATION REGULAR ESTATE. This form is used to open a formal probate estate in the state of Maryland when the decedent’s assets exceed $50,000 in total value (or $100,000 if the surviving spouse is the sole heir or legatee). This form is submitted to the Orphans’ Court or Register of Wills to request the appointment of a personal representative who will administer the decedent’s estate. It is typically filed when the estate includes significant real or personal property solely owned by the decedent that must go through probate. The petitioner must provide information confirming their eligibility, including their relationship to the decedent, mental competency, criminal background, and entitlement to serve under Maryland law. The form also requires disclosure of whether a valid will exists, how it was obtained, and any known prior legal proceedings involving the decedent. Along with the petition, Schedule A must be completed, which provides a detailed estimate of the estate’s value and any unsecured debts. Upon approval, the court may admit the will to probate (if one exists), issue letters of administration, and authorize the personal representative to collect assets, pay debts and taxes, and distribute the remaining property to heirs or beneficiaries. www.FormsWorkflow.com
