RW1103 - PETITION FOR ADMINISTRATION SMALL ESTATE. This form is used to initiate the probate process in Maryland when an individual has died and left property that must be administered through the court. This form is submitted to either the Orphans' Court or the Register of Wills and is required whether the estate is a regular estate (valued over $50,000, or $100,000 if the spouse is the sole heir or legatee) or a small estate (valued at or below those same thresholds). The form provides information about the decedent, including their domicile, date, and place of death, and identifies the person(s) petitioning to be appointed as personal representative(s). The petitioners must affirm they are legally qualified and competent to serve in this role, that they are not disqualified due to criminal convictions or other legal barriers, and that they have searched for and located (or confirmed the absence of) a valid will or codicil. Depending on the type of estate, petitioners must also attach additional schedules (Schedule A or B), listing the decedent’s assets, debts, and interested persons. In the case of a small estate, Schedule B is included to list all known assets, debts, and claimants, and to provide an estimate of funeral expenses, family allowances, and administrative costs. This schedule also confirms the petitioner’s intention to pay claims in the proper legal order and distribute the estate accordingly.
