Description
Form 2DC51 - PETITION FOR EX PARTE TEMPORARY RESTRAINING ORDER AND FOR INJUNCTION AGAINST HARASSMENT; DECLARATION OF PETITIONER(S); TEMPORARY RESTRAINING ORDER AGAINST HARASSMENT; AND NOTICE OF HEARING. This form is used in the State of Hawai‘i Second Circuit District Court by individuals seeking immediate court protection from harassment. This form allows a petitioner to request a temporary restraining order (TRO) without prior notice to the respondent, based on recent acts of harassment or credible threats of harassment. The petitioner must provide a sworn declaration describing the harassment and any threats, including details about any firearms or electric guns the respondent may possess. If the judge finds probable cause, a TRO is issued to prohibit the respondent from contacting, harassing, visiting the petitioner’s home, workplace, or school, and from possessing firearms or ammunition. The TRO is effective immediately upon filing and typically lasts for 15 days, during which a formal hearing is scheduled. At the hearing, both parties may present evidence, and the court may issue an injunction prohibiting further harassment for up to three years if harassment is proven by clear and convincing evidence. www.FormsWorkflow.com
