CCR-A-180-190 - AFFIDAVIT FOR SERVICE BY PUBLICATION / ORDER OF PUBLICATION. These These forms are used in the Fairfax Circuit Court for cases involving a minor child’s legal name change when one of the natural parents cannot be located or served with court documents. The Affidavit for Service by Publication is filed by the petitioning parent or guardian to request that notice of the name change petition be published in a newspaper instead of being personally served on the other natural parent. This is necessary when the other parent’s whereabouts are unknown, they are a non-resident, or prior attempts to serve them through the sheriff’s office have been unsuccessful. The petitioner must state, under oath, the last known address of the other parent and provide details regarding their attempts to locate them. This affidavit must be notarized before submission. Once the affidavit is filed, the court issues an Order of Publication, which directs that notice of the name change request be published in a newspaper to inform the absent parent of the proceedings. The order gives the parent a deadline to appear in court and protect their rights.
