Description

MOTION TO CORRECT CLERICAL ERROR IN JUDGMENT AND DECLARATION IN SUPPORT. This form is used in the Circuit Court of the State of Oregon when a party in a case—either the petitioner or respondent—requests the court to correct a clerical mistake in a previously signed judgment. This could include typographical errors, mistakes in the money award section, or inaccuracies in a particular page or section of the judgment that resulted from oversight or omission. The form is based on Oregon Rule of Civil Procedure (ORCP) 71A, which allows the court to correct such errors at any time, either on its own initiative or upon the motion of a party, with proper notice given to all involved parties. The party filing this motion must clearly identify the date the judgment was signed and describe the nature and location of the clerical error within the judgment. They must also declare, under penalty of perjury, that the information provided is true and complete to the best of their knowledge. The form includes a certificate of mailing to verify that copies of the motion were sent to the other party unless service is not required due to default. www.FormsWorkflow.com
