ELECTION AS TO TRIAL / WAIVER OF RIGHT TO BE TRIED BY JURY / DEFENSE COUNSEL’S CERTIFICATE. This form is used in the Boston Municipal Court Department of the Trial Court of Massachusetts for the purpose of recording the defendant's election as to the type of trial they prefer. It includes sections for the defendant to choose between a trial by jury or a trial without a jury, and to provide their signature and the date. If the defendant elects a trial without a jury, there is an additional section for the defendant to sign a waiver of their right to be tried by a jury, indicating their decision to be tried by the court without a jury. Furthermore, if the defendant chooses a trial without a jury, the form includes a section for the defense counsel to certify that they have explained the implications of waiving the right to a jury trial to the defendant, such as the composition and role of a jury compared to that of a judge.
