Description
CIV-139 - REQUEST FOR DISCOVERY CONFERENCE CCP §2016.080. This form from the Amador County Superior Court is used for requesting a discovery conference pursuant to California Civil Procedure Code Section 2016.080. The requesting party (plaintiff or defendant) uses this form to briefly describe the nature of a discovery dispute, including the relevant facts and legal arguments. A supporting "Meet and Confer" declaration, as required by CCP §2016.040, must be attached and should not exceed two pages. Once filed with the court, the request must be served on the opposing counsel in the same manner as it was filed with the clerk. The opposing party has two court days from receipt of the request to file any opposition, which must also be served on the opposing counsel in the same manner. The court then issues an order on the request for the discovery conference, indicating whether the request is granted or denied. If granted, the court may set a hearing date and time for the discovery conference in a specified department. www.FormsWorkflow.com
