NOTICE OF VOLUNTARY DISMISSAL. This form is used in the Oregon Circuit Court by either the petitioner or both parties jointly to officially request the dismissal of a family law case, such as a divorce or custody proceeding. The form allows the initiating party to voluntarily end the case, provided certain legal conditions are met—for example, it must be the first dismissal of this type against the respondent, and no counterclaim must have been filed by the other party. If both parties agree, they can jointly stipulate to the dismissal by signing the form. The notice also includes important information about required service to the other party and to any adult children involved in the case who are between the ages of 18 and 20. Once filed, the court may enter a General Judgment of Dismissal, officially closing the case either with prejudice—meaning it cannot be refiled—or without prejudice, allowing it to be reopened later. If a fee deferral was granted earlier, it must be noted in the form. The filing party must comply with Uniform Trial Court Rule (UTCR) 5.100, which requires sending a copy of the proposed judgment or order to the other party at least seven days before submitting it to the court.
