ALA CIV-100, NOTICE OF CASE MANAGEMENT CONFERENCE AND ORDER (Unlimited Jurisdiction). This form notifies all parties involved in a case that a case management conference has been scheduled, along with the date, time, location, and judge assigned to the case. It also includes a set of orders that all parties must follow before and during the conference, and the consequences of not complying with those orders. The orders listed in the Notice include the plaintiff's obligation to serve all named defendants and file proofs of service with the court within 60 days of filing the complaint and to give notice of the conference to all parties involved. The defendant is required to respond as stated on the summons. All parties who have appeared in the case before the conference must meet and confer in person or by telephone, file and serve a completed Case Management Conference Statement at least 15 days before the conference, and post jury fees as required by Code of Civil Procedure section 631. If any of the orders listed are not followed, the court may issue an order to show cause why the party should not be sanctioned. Sanctions may include monetary sanctions, striking pleadings, or dismissal of the action. The Notice also orders all parties to appear in person or through their attorney of record at the Case Management Conference and to be thoroughly familiar with the case and fully authorized to proceed. The parties may be able to appear at the conference by telephone, and they can file Case Management Conference Statements by E-Delivery. Lastly, the judge may place a Tentative Case Management Order in the case's online register of actions before the conference, which may establish a discovery schedule, set a trial date, or refer the case to Alternative Dispute Resolution, such as mediation or arbitration.
