CR -315 - WAIVER OF DEFENDANT’S PERSONAL PRESENCE. This form from the Sacramento Superior Court is used in criminal cases when a defendant voluntarily chooses to waive their right to be physically present in court for certain proceedings. By signing this form, the defendant acknowledges that they have been informed of their constitutional rights, including the right to be present during hearings, to confront and cross-examine witnesses, and to be present when legal arguments are made. Despite these rights, the defendant agrees to allow the court to proceed in their absence for various types of hearings—such as motions, trial settings, continuances, bail hearings, motions to reduce sentences, and hearings involving legal issues—while being represented solely by their attorney. The defendant waives their right to have a preliminary examination within the statutory timelines set by Penal Code Section 859b, which requires such hearings to occur within 10 court days of arraignment or plea, and no more than 60 days thereafter.
