CRIM 261 - PETITION TO WITHDRAW PLEA AND DISMISS COMPLAINT OR INFORMATION AND DISTRICT ATTORNEY RESPONSE (PC §1203.43), This is a Los Angeles Superior Court form used to withdraw a prior guilty or no contest plea entered under a Deferred Entry of Judgment (DEJ) program pursuant to Penal Code §§ 1000 and 1203.43. This petition applies to defendants who were granted DEJ on or after January 1, 1997, completed the program, and had charges dismissed under Penal Code § 1000.3. The form allows the defendant to request withdrawal of the plea, entry of a not guilty plea, and dismissal of the charges due to misinformation regarding immigration consequences or other statutory grounds under § 1203.43.
