REQUEST FOR REASSIGNMENT TO A UNITED STATES DISTRICT JUDGE. This form is used in the U.S. District Court for the District of Idaho when a party in a civil case no longer consents to having the case heard by a U.S. Magistrate Judge. Under 28 U.S.C. § 636(c)(4), Federal Rule of Civil Procedure 73(b), and District of Idaho General Order No. 237, parties in civil cases may initially consent to have their case handled by a Magistrate Judge. However, this form allows a party to formally request that the case be reassigned to a U.S. District Judge instead. By submitting this form, the party is asking the court to vacate the reference to the Magistrate Judge so that a District Judge can preside over the proceedings.
