AMENDMENT TO COMPLAINT (Fictitious /Incorrect Name). This is a Superior Court of California, County of Humboldt form used to correct or update a defendant’s name in a filed complaint. It allows a plaintiff to substitute the true name of a defendant when the original complaint used a fictitious name (due to lack of knowledge) or an incorrect name. For fictitious name amendments, no court order is required, while corrections of incorrect names require judicial approval. The form includes sections for identifying the original and corrected names and provides an order section for court approval when needed. Adopted for Mandatory Use. Code Civ.
